Bannds respects the intellectual property rights of artists, songwriters, labels, publishers, producers, performers, creators, venues, audiovisual rights holders, and other lawful rights owners.
In accordance with the Digital Millennium Copyright Act (“DMCA”), applicable copyright law, and Bannds’ internal copyright risk management procedures, Bannds responds to valid infringement notices, ownership disputes, automated infringement detections, user reports, payment processor alerts, and other credible intellectual property complaints relating to content hosted, streamed, distributed, sold, displayed, or monetized through the Bannds platform.
This DMCA Copyright Policy describes the procedures for submitting infringement notifications, counter-notifications, ownership documentation, uploader cooperation materials, and related rights claims, and further describes Bannds’ discretionary enforcement rights regarding allegedly infringing content.

- or any other Platform feature.

- Reporting Copyright Infringement or Rights Violations
If you believe copyrighted or otherwise protected material has been uploaded, streamed, listed, sold, distributed, displayed, or made available on Bannds without authorization, you may submit a notice to Bannds’ designated copyright agent.
A valid notice should include:
- identification of the copyrighted or protected work claimed to be infringed
- identification of the allegedly infringing material and its location on the Platform (including URL, profile, listing, upload identifier, or screenshot where possible)
- your name, mailing address, telephone number, and email address
- a statement that you have a good faith belief the disputed use is not authorized by the copyright owner, rights holder, its agent, or applicable law
- a statement that the information provided is accurate and that you are authorized to act on behalf of the owner or rights holder
- your physical or electronic signature
Incomplete notices may be delayed, declined, or require supplemental documentation.
Bannds may also review and act upon other credible intellectual property complaints even if not submitted in formal DMCA format.

Bannds may investigate and act upon potentially infringing content based on:

- internal discretionary review
Bannds is not required to wait for a formal DMCA notice, lawsuit, or claimant demand before taking protective enforcement action.
Bannds may proactively mute, remove, demonetize, suppress, disable, or restrict any content Bannds reasonably believes may contain unauthorized copyrighted material or otherwise create intellectual property liability.

- Audiovisual Uploads, Background Music, Cover Performances, and Concert Footage
Because Bannds permits audiovisual uploads and social media sharing features, this Policy expressly applies to:
- videos containing copyrighted commercial music
- videos containing incidental or background copyrighted music
- fan-captured concert footage
- venue performance recordings
- cover song performances lacking rights clearance
- television or film audio
- radio broadcasts
- third-party protected visual media
- unauthorized clips containing label-owned recordings
The fact that a user personally filmed, recorded, performed in, captured, or uploaded audiovisual content does not establish lawful ownership of the underlying music, composition, synchronization rights, or third-party intellectual property embodied within that content.
Bannds may mute, remove, demonetize, suppress, disable, or permanently delete such uploads in its sole discretion.

- Bannds Review, Removal, Demonetization, Earnings Holds, and Clawbacks
Upon receipt of a valid DMCA notice, other credible rights complaint, or internal infringement detection, Bannds may in its sole discretion:
- remove or disable access to allegedly infringing material
- mute or suppress audiovisual content
- demonetize or suspend monetization associated with the material
- freeze pending earnings associated with the disputed material
- reverse unpaid monetization balances
- claw back previously credited creator earnings where reasonably necessary
- notify the uploader or affected account
- request rights documentation from the uploader
- restrict future upload privileges
- take any additional protective actions necessary to maintain legal, payment processor, advertiser, app marketplace, or Platform compliance
Bannds may retain associated transaction records, upload metadata, payout records, moderation records, and claimant communications pending review.

- Documentation Requests and Mandatory Uploader Cooperation
Users whose content becomes subject to a copyright or ownership complaint may be required to provide:
- ownership documentation
- licenses
- split sheets
- distributor agreements
- publishing details
- synchronization permissions
- collaborator approvals
- producer permissions
- venue permissions
- event recording permissions
- legal explanations
- other supporting records reasonably requested by Bannds
Users are required to cooperate fully and timely with Bannds’ copyright investigations.
Failure to provide satisfactory documentation or cooperate with review requests may result in:
- continued removal
- demonetization
- payout holds
- earnings forfeiture
- upload restrictions
- account suspension
- permanent termination

- Counter-Notification Procedure
If you believe content removed or disabled by Bannds was removed due to mistake, misidentification, or inaccurate ownership claim, you may submit a counter-notification.
A valid counter-notification should include:
- identification of the removed material and its prior location on the Platform
- your name, mailing address, telephone number, and email address
- a statement under penalty of perjury that you believe the material was removed due to mistake or misidentification
- a statement consenting to the jurisdiction of the applicable federal court in your district, or the district where Bannds is located if outside the United States
- your physical or electronic signature
Bannds may require additional supporting documentation beyond a formal counter-notification where ownership, licensing, audiovisual rights, or monetization rights remain unclear.

- Restoration Is Not Guaranteed
If Bannds receives a valid counter-notification, Bannds may forward the submission to the original claimant.
Bannds may, but is not obligated to, restore removed or disabled content if:
- the original claimant does not pursue legal action, and
- Bannds determines in its sole discretion that sufficient ownership clarity, legal comfort, compliance comfort, advertiser safety, and Platform safety exist.
Bannds retains sole discretion regarding restoration, monetization reinstatement, earnings release, and future upload privileges.

- Repeat Infringer and Repeated Rights Dispute Policy
Bannds maintains a strict policy for restricting, suspending, demonetizing, muting, disabling, or permanently terminating users who repeatedly:
- upload infringing material
- upload disputed ownership material
- upload unauthorized audiovisual media
- upload videos containing copyrighted music without rights clearance
- fail rights verification reviews
- submit unsupported ownership assertions
- abuse the counter-notification process
Bannds may determine repeat infringement or repeated rights abuse in its sole discretion based on notices received, documentation failures, internal moderation findings, or recurring ownership conflicts.
Bannds is not required to wait for formal adjudication of infringement before taking repeat infringer action.

- Misrepresentation, False Claims, and False Certifications
Submitting knowingly false copyright notices, ownership complaints, ownership certifications, uploader certifications, or counter-notifications may result in:
- account suspension or termination
- forfeiture or withholding of pending earnings
- reversal of prior monetization
- disclosure to affected parties
- legal liability under applicable law
Users are solely responsible for the truthfulness and accuracy of all rights-related submissions made to Bannds.

- Platform Role and Enforcement Discretion
Bannds operates as a user-generated content and user-monetized platform.
Bannds does not independently pre-verify ownership of all uploaded materials and relies in part on uploader certifications, claimant notices, user reports, payment processor alerts, automated moderation systems, and rights-holder communications.
Bannds reserves broad and final discretion to remove, mute, disable, demonetize, freeze, suppress, restrict, retain records regarding, or otherwise act upon disputed or suspected infringing material where Bannds determines such action is reasonably necessary to protect:
- intellectual property rights
- payment compliance
- legal compliance
- advertiser compliance
- app marketplace compliance
- Platform integrity
- user safety
